This position drives the ASCO Power export control and trade compliance program by implementing required processes and controls at the ASCO entity level, managing escalations, and working with internal stakeholders from all disciplines to ensure adherence to export controls and trade regulations, company policies and Key Internal Controls.
This role reports to ASCO CFO and works closely with Global Export Control driving the global export control compliance program.
Roles & Responsibilities
Implement and maintain export control program within ASCO- First point of contact as export control authority within the company
- Oversee adherence to applicable export control & sanction regulations and requirements
- Implement and manage Escalations, including Restricted Party, Sanctioned/Embargoed country, Export Control Clause screening
- Monitor and report in a timely manner on the development & changes of the export controls and regulations
- Support reviews & audits, generate reports to management and lead improvement activities
- Validate applicable controls assessments for ASCO entity, define action for non-compliance, follow up on progress to ensure controls are implemented successfully.
- Implement and maintain export license procedure and assist in the determination of export license requirements
- Perform training of employees at all levels on a frequent basis and advise related stakeholders on local/global new regulations
- Develop & advise procedures that are “self-checking” and performs ad-hoc internal audits ensuring adherence to export control & sanctions related regulations
- Ensure continuous improvement of all export control related systems, policies and procedures
- Implement product classification controls and manage escalations upon request
- Develop and prepare periodic updates and metrics reports related to export control & sanctions as applicable
- Maintain system of compliance and internal controls for adherence to the International Traffic in Arms regulations (ITAR)
- Implement system of access control for unlicensed foreign nationals to any controlled technology or controlled technical data that does not qualify for an exclusion to export control regulations.
- Create, coordinate, and maintain record retention systems in accordance with policies and procedures.
- As required, lead and support control systems for compliance with other rules, regulations and internal policies, including Import, Conflict Minerals, ESG
- As needed, support other Internal Control areas not associated with import/export, including commercial, operational finance, contract management, among other areas
Required Qualifications
Minimum five (5) years prior experience in a trade compliance role.
Must be a US person as defined by ITAR.
- Fundamental knowledge of ITAR, EAR, OFAC, CBP and other import/export regulations.
- Excellent attention to detail, accurate recordkeeping skills.
- The ability to effectively handle time-sensitive, critical issues despite setbacks, obstacles and time constraints.
- This position is subject to the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR). Access to export controlled technology by individuals other than U.S. Persons (as defined in §120.62 of the ITAR and Part 722 of the EAR) requires approval by the U.S. government. It is necessary for ASCO to identify the citizenship of candidates being offered positions requiring access to export controlled technology to determine if a U.S. government authorization is required. Your employment will be contingent upon ASCO ability to obtain necessary approvals as required by the law to place you in the position.
