About IQOS

The U.S. Food and Drug Administration (FDA) has authorized the marketing of our flagship electronically heated tobacco system, IQOS, as a modified risk tobacco product (MRTP), which represents a historic opportunity for public health. In doing so, the agency found that issuing an exposure modification order for the IQOS Tobacco Heating System (THS) is appropriate to promote the public health, and is expected to benefit the health of the population as a whole.
This decision demonstrates that IQOS is fundamentally different from combustible cigarettes, and a better choice for adults who would otherwise continue smoking. It follows a review of the extensive scientific evidence package PMI submitted to the FDA in December 2016 to support its MRTP applications.

The FDA’s action authorizes the marketing of IQOS in the USA with the following information:
  • The IQOS system heats tobacco but does not burn it.
  • This significantly reduces the production of harmful and potentially harmful chemicals.
  • Scientific studies have shown that switching completely from conventional cigarettes to the IQOS system significantly reduces your body’s exposure to harmful or potentially harmful chemicals.

In April 2019, the agency authorized IQOS for sale in the U.S. through issuance of premarket tobacco product application marketing orders, that deemed marketing the product to be appropriate for the protection of the public health. Now, the FDA has concluded issuing an IQOS exposure modification order is appropriate to promote the public health, and is expected to benefit the health of the population as a whole, taking into account both users and nonusers of tobacco products. Notably, the FDA’s issuance of an exposure modification MRTP order does not mean IQOS is FDA-approved. FDA does not ‘approve’ tobacco products. Further, the FDA’s decision does not mean IQOS is risk-free.

The FDA’s decision is consistent with earlier conclusions of other leading regulatory and scientific bodies, including in the U.K., Germany, and the Netherlands, which have found that the product emits lower levels of harmful toxicants. Furthermore, the FDA’s MRTP authorization shows that IQOS is a fundamentally different product than combustible cigarettes, and must be regulated differently, as the FDA has recognized.

As of March 31, 2020, PMI estimates that approximately 10.6 million adult smokers around the world have already stopped smoking and switched to IQOS. We believe that this decision can help to further accelerate the transition of U.S. adults away from cigarettes. We, along with our licensee Altria, are committed to guarding against unintended use and fully support FDA’s focus on protecting youth.


Role Summary

An experienced attorney within the Legal Department who will be effective in exercising seasoned judgment and providing guidance to business and functional leaders, privacy professionals and other lawyers across the organization on a range of privacy matters. Responsibility for performing a variety of moderately complex to complex legal matters and leading projects including day-to-day advice to the company and its business professionals on privacy compliance. Reporting to the Senior Counsel – Cybersecurity & Data Privacy, this role will require a person of vision, integrity, commitment, maturity, judgment and meticulosity.

Responsibilities will include:
  • Effectively building and maintaining strong external and internal relations;
  • Providing guidance and recommendation of data privacy strategy, policy, and practice for the family of PMI products to the general counsel and senior management;
  • Providing trusted business partnership and counselling on data privacy decisions of importance to the Company and, as appropriate, contributing to the corporate strategy planning process;
  • Maintaining responsibility for designated practice areas as determined by the General Counsel;
  • Demonstrating an inclusive, consultative and thoughtful approach to achieving cross-functional alignment on issues internally;
  • Ensuring that legal services provided are cost-effective, practical, strategic, and consistent with the company’s philosophies while creating an environment of collaboration with business partners and Legal Department colleagues to help drive continual process and policy improvements;
  • Contributing to and ensuring delivery on Legal Department business goals and the overall business plan of the company, ensuring that the Legal Department implements leading practices and operates at the highest ethical standards and developing emerging talents in the organization, including in the field of data privacy law.

Key Responsibilities:

  • Consult with and advise the Company on appropriate legal requirements and risks related to privacy, security and information management, with a particular focus on substantive privacy related matters.
  • Counsel and advise senior management and various legal, IT, Information Security, Consumer, Commercial and other business teams on mitigating global privacy risks.
  • Monitor evolving laws, regulations, and best practices in the area of privacy, medical devices and Artificial Intelligence to help identify critical legal issues and practical compliance solutions for the Company.
  • Provide pragmatic guidance globally, and at the country level, for changes in privacy and related laws to allow the Company to make adjustments to PMI’s agile programs.
  • Translate complex privacy and related laws and regulations into technical and operational legal requirements while working closely and coordinating with information security and technology teams.
  • Work closely with internal business partners to understand their business processes, applications, projects, new products and technologies to ensure compliance with relevant global privacy laws, regulations, and best practices.
  • Help design and embed privacy requirements and controls into projects, products, technologies, initiatives, and services throughout the Company.
  • Draft, review, and support negotiations regarding privacy contractual provisions and controls in a wide variety of commercial agreements, complex data sharing agreements and arrangements in the countries and territories around the world where PMI conducts business.
  • Develop and implement effective global and local strategies, policies, notices, standards, controls, and training materials in the area of privacy.
  • Assist with breach response and breach notification requirements for the jurisdictions in which the Company operates including advising on stakeholder (e.g., employees, customers, suppliers, etc.) and potential regulatory and local law enforcement notification.
  • Identify and advise on legal and compliance issues arising out of various internal and external privacy audits, security assessments, tests, reviews, and ongoing program improvement efforts.
  • Maintain strong coordination, cooperation, and mutual support between the Legal Department and other corporate departments with compliance obligations to ensure and privacy compliance roles and responsibilities are fulfilled effectively, such as Internal Audit, People & Culture, Risk & Controls, Communications, External Affairs, Finance, and Information Technology.
  • Work on complex problems where analysis requires identification and evaluation of multiple factors and that impact significant areas of the Company.
  • Manage legal matters handled by outside counsel. Select outside counsel for matters from pre-selected counsel.
  • Work primarily with independent judgment, consulting with more senior attorneys as needed.
  • Identify need for and participate in cross-functional working groups in identified areas of expertise or development; engage with senior leadership of the Company on legal matters with minimal supervision.

Knowledge and experience desired to undertake this role

  • LLB or Juris doctor and licensed to practice law in a locale where PMI operates.
  • At least five years of concentrated experience which demonstrate an in-depth knowledge and applied understanding of area of expertise; both in house and major law firm experience preferred. Retail and/or experience in the life sciences sector is a bonus.
  • Solid working knowledge of data privacy laws, regulations, and best practices.

Work Environment/Physical Requirements

Annual Base Salary Range: $135,600- $186,456
