This position has the direct responsibility to manage and oversee the work of the Managers, Trials & Investigations within the LIRR Labor Relations Department; including the work to support the major operating departments of Transportation, Maintenance of Equipment and Engineering. The position ensures effective and timely processing of investigations and trials pursuant to the collective bargaining agreements and the Railway Labor Act. This position is charged with providing advice to department heads and senior staff to ensure the consistency and standardization of employee disciplinary action and dispute resolution among the various departments at the LIRR.
Responsibilities may include but are not limited to:
Responsible to manage, supervise and coordinate the day-to-day activities of the three departmental trial offices, including the work of the Managers, Trials & Investigations (2) and Assistant Manager, Trials & Investigations (1) including the oversight of departmental investigations involving employee misconduct, the writing of accurate and timely disciplinary charges, trials, and labor-management dispute resolution.- Review, investigate and provide oversight regarding all disciplinary charges and departmental reports alleging violations that require disciplinary action. Instruct department managers in the proper procedures to be followed in preparing appropriate documentation and in the utilization of other investigatory techniques. Determine when trial waivers are appropriate and recommend decisions based upon trial transcripts.
- Provide direction to departmental managers and senior management within each department on how to effectively handle and manage labor-management issues and dispute resolution.
- Review, conduct, and address all complicated and sensitive investigations, trials and departmental issues of a highly visible nature. Ensure fair resolution to such issues while maintaining and protecting the interests of the agency.
- Coordinate training programs for managers within departments to enable them to interpret union contracts as well as competently handle and investigate misconduct, absence control trials, drug and alcohol trials, rules and safety violations, and proper follow-up procedures.
- Recommend, create or modify policy/procedures relating to employee disciplinary action for the departments as well as the agency as needed. Responsible for making changes to and enforcing labor-management policies. Ensure maintenance of the disciplinary database(s) and analyze data.
- Represent the Labor Relations Department at internal meetings concerning policy updates and changes.
- Select, develop and motivate personnel within the department. Provide career development for subordinates. Provide prompt and effective coaching and counseling. Responsible for discipline/termination of employees when necessary. Review direct reports and approve performance appraisals. Promote safe work practices and provide safe working conditions. Create a professional environment that respects individual differences and enables all employees to develop and contribute to their full potential.
- Ensure a safe working environment and adherence to guidelines of company safety policies and procedures. Lead by example. Enforce LIRR’s safety rules and regulations.

Qualifications
- Must possess a Bachelor’s Degree in Labor Relations, Human Resources, or a related field. Demonstrated, directly related, equivalent experience and education may be considered in lieu of the degree, subject to approval.
- Must possess a minimum of approximately 7 to 10 years demonstrated, recent, directly related Labor Relations experience.
- Must have progressively responsible, recent, related practical labor relations experience, with an emphasis on performing investigations, presenting trials, and experience with dispute resolution and effectively settling cases.
- Must have detailed knowledge of labor agreements and negotiations, along with the knowledge of appeals, grievances, and trial procedures.
- Must possess supervisory experience (approximately 3 to 5 years) particularly at the managerial level.
- Must have the ability to successfully coordinate and manage diverse issues simultaneously.
- Must possess strong interpersonal skills with ability to diplomatically deal with all levels of the organization.
- Must possess good computer skills.
- Must have effective communication, presentation, critical thinking/problem solving, decision-making, negotiating, and judgment skills.
Preferred/Desirable Skills/Qualifications:
- Knowledge of Railway Labor Act and railroad operations.
- Advanced degree in Labor Relations or related field.
- Experience performing investigation and trial work at the LIRR is preferred.
In addition to meeting the minimum requirements of the position, the selection process may include, but is not limited to a pre-screening assessment (i.e., physical, written and/ or practical evaluation) and interview. Candidates forfeit further consideration in the process if they fail to participate in any step of the process when scheduled. Make up dates/times will not be given. In addition, LIRR employee applicants must be in their current position for the 12 months immediately preceding the close date of this posting and must possess a satisfactory work history, including attendance and discipline record. A record of more than ten sick days without medical documentation in two of the last three years is considered unsatisfactory attendance.
